Game of FLIP – Terms of Service

Welcome to Game of FLIP (“Game of FLIP”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Game of FLIP mobile application, website, services, premium subscriptions, challenges, content, and related features (collectively, the “Services”). By downloading, purchasing, accessing, subscribing to, or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, do not use the Services.

2. Nature of the Services

Game of FLIP is an entertainment and recreational application that generates random trampoline tricks, combinations, challenges, and related content. The Services are intended solely for entertainment purposes.

Game of FLIP does not provide:

The Services do not evaluate your experience, training, physical condition, skill level, equipment, environment, or ability to perform any activity safely. All tricks, challenges, and recommendations generated by the Services are automated, randomly generated suggestions only.

3. Safety Information and Compliance

Game of FLIP is a digital entertainment application. It is not a trampoline, sports equipment, protective equipment, or a safety device, and it does not control, supervise, monitor, or take part in any physical activity you perform.

Before using a trampoline or attempting any activity, you are solely responsible for reading and following the safety instructions, warnings, age and weight limits, and assembly, inspection, and maintenance guidance provided by the manufacturer of your trampoline and any related equipment, as well as all applicable safety standards, laws, and regulations in your country or region.

The warnings and safety information contained in the Services are provided for general awareness only. They do not replace professional instruction, manufacturer guidance, or applicable safety regulations, and you must always prioritise those over any suggestion generated by the Services.

4. Assumption of Risk

You understand and acknowledge that participation in trampoline activities and related sports involves inherent and unavoidable risks. You voluntarily choose to participate in such activities and knowingly assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable.

9. Exclusive Club Subscription

Game of FLIP may offer premium content through the Exclusive Club subscription.

All Exclusive Club content is provided for entertainment purposes only. The inclusion of a challenge within Exclusive Club does not constitute:

Users must independently assess whether a challenge is suitable for their age, skill level, experience, physical condition, and training. Users agree to participate only in challenges that are within their personal skill level. Neither Game of FLIP nor any participating athlete, influencer, ambassador, coach, creator, featured user, or third party assumes responsibility for any injury, loss, damage, disability, paralysis, or death resulting from participation in Exclusive Club content.

10. No Coaching or Training Relationship

Nothing within the Services shall be interpreted as creating a professional coaching, instruction, training, supervision, certification, mentorship, or athletic relationship. Any content provided by Game of FLIP or its creators is intended solely for entertainment purposes. No coach-athlete, instructor-student, trainer-client, mentor-participant, or similar professional relationship is created through use of the Services.

11. Third-Party Content

The Services may include content created by third parties, including athletes, influencers, ambassadors, coaches, creators, featured users, or other contributors. Game of FLIP does not independently verify the safety, suitability, accuracy, or appropriateness of third-party content. Users assume all risks associated with participating in activities suggested by third-party content. Game of FLIP is not responsible for any actions, statements, instructions, or recommendations made by third parties.

12. Minors and Parental Responsibility

Users under the age of 18 may only use the Services with the permission of a parent or legal guardian. By using the Services, users under 18 represent and warrant that they have obtained such permission.

13. Medical Disclaimer

Game of FLIP does not provide medical advice. Nothing contained within the Services should be interpreted as medical, physical therapy, rehabilitation, health, or fitness advice. Users should consult qualified medical professionals regarding their fitness to participate in trampoline activities.

14. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Game of FLIP disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and safety.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Game of FLIP and the parties listed in the Release below shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, nor for any personal injury, death, disability, paralysis, property damage, emotional distress, or loss of income, arising out of or related to your use of the Services or your participation in any activity, whether based on contract, tort (including negligence), or any other legal theory.

If liability cannot be excluded under applicable law, the total aggregate liability of Game of FLIP shall not exceed the total amount you paid to Game of FLIP during the twelve (12) months preceding the event giving rise to the claim.

16. Release and Waiver of Liability

To the maximum extent permitted by applicable law, you hereby release, waive, discharge, and hold harmless Game of FLIP and its owners, directors, employees, contractors, affiliates, licensors, partners, athletes, influencers, ambassadors, content creators, representatives, and successors from any and all claims arising out of or related to:

17. Mandatory Rights and Severability

Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under applicable mandatory law. In particular, nothing in these Terms affects your mandatory statutory consumer rights, or excludes or limits liability for death or personal injury to the extent it results from intent or gross negligence on the part of Game of FLIP where such exclusion is not permitted by law.

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. The waivers and limitations in these Terms shall apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Game of FLIP and its owners, employees, contractors, affiliates, licensors, ambassadors, influencers, athletes, creators, representatives, and partners from and against any claims, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable legal fees, arising from:

19. Subscriptions and Payments

Certain features may require payment, including the Exclusive Club subscription. Subscriptions may automatically renew unless cancelled through the applicable platform. Payments are processed through the Apple App Store or Google Play Store. Subscription management, cancellation, billing, and refunds are governed by the policies of the applicable platform provider.

20. Intellectual Property

All content, software, trademarks, logos, designs, graphics, text, videos, and intellectual property associated with Game of FLIP remain the exclusive property of Game of FLIP or its licensors. No portion of the Services may be copied, reproduced, modified, distributed, sold, or exploited without prior written permission.

21. Termination

We reserve the right to suspend, restrict, or terminate access to the Services at any time and for any reason. Termination shall not affect provisions intended to survive termination, including Assumption of Risk, Release and Waiver of Liability, Limitation of Liability, Indemnification, Mandatory Rights and Severability, and Governing Law.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Game of FLIP regarding the Services and supersede any prior agreements. Our failure to enforce any provision shall not constitute a waiver of that provision.

23. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on our website. Continued use of the Services following an update constitutes acceptance of the revised Terms.

24. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of The Netherlands, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be submitted exclusively to the competent courts of The Netherlands, to the fullest extent permitted by applicable law.
